Welcome to Back Room Bookings Pty Ltd (“we,” “our,” or “us”). These Terms and Conditions (“Terms”) govern the use of our online platform, which connects individuals seeking to book short-term accommodation (“Guests”) with property owners or managers offering such properties (“Hosts”).

By accessing, browsing, or using our platform, you acknowledge that you have read, understood, and agree to be bound by these Terms.

1. Our Role

• 1.1. Back Room Bookings Pty Ltd operates as a neutral third-party platform to facilitate bookings between Guests and Hosts.
• 1.2. We do not own, lease, manage, or operate any of the properties listed, nor do we act as a real estate agent, travel agent, or property insurer.
• 1.3. We are not a party to any booking agreement entered into between the Guest and the Host.

2. Booking Process

• 2.1. Guests may search for and request to book properties listed by Hosts on the platform. Hosts have full discretion to accept or decline booking requests.
• 2.2. Once a booking is confirmed by the Host, a legally binding agreement is formed between the Guest and the Host. You agree to comply with the terms, conditions, and house rules set by the Host.
• 2.3. The total amount payable (including accommodation fees, service charges, cleaning fees, and applicable taxes) will be clearly displayed before booking confirmation.

3. Payments and Fees

• 3.1. Payment for bookings is facilitated through our secure online payment system. We may collect payment from Guests on behalf of Hosts.
• 3.2. Back Room Bookings Pty Ltd may charge a service fee to Guests and/or Hosts for the use of the platform. These fees will be clearly communicated during the booking process.
• 3.3. Payments are remitted to the Host after check-in, less applicable fees if any.

4. Cancellations and Refunds

• 4.1. Each Host sets their own cancellation policy (e.g., flexible, moderate, strict). The applicable cancellation policy will be displayed on the property listing and in the booking summary.
• 4.2. If a Guest cancels a booking, refunds will be issued according to the Host’s cancellation policy.
• 4.3. If a Host cancels a booking, Guests will receive a full refund. In such cases, we may assist in finding alternative accommodation but are not obligated to do so.
• 4.4 Back Room Bookings Pty Ltd reserves the right to withhold refunds in the case of Guest misconduct, rule violations, or failure to comply with these Terms

5. Guest Responsibilities

• 5.1. Guests agree to:
  • ∙ Use the property only for lawful, personal, and holiday purposes.
  • ∙ Treat the property and its contents with care and respect.
  • ∙ Comply with all house rules, check-in/check-out times, and local laws.
  • ∙ Refrain from hosting parties or exceeding the occupancy limit unless expressly permitted by the Host.
• 5.2. Guests may be held financially responsible for damage, theft, or breach of rules, and such claims may be facilitated through the platform.

6. Host Responsibilities

• 6.1. Hosts agree to:
  • ∙ Provide accurate descriptions, pricing, and availability of their properties.
  • ∙ Maintain cleanliness, safety, and legal compliance of the property.
  • ∙ Honour confirmed bookings and ensure access to the property as agreed.
• 6.2. Hosts are solely responsible for obtaining any required licenses, permits, or insurance.

7. Liability and Disclaimers

• 7.1. While we strive to verify listings and users, Back Room Bookings Pty Ltd does not guarantee the quality, legality, or suitability of any property or user.
• 7.2. We are not liable for:
  • ∙ Personal injury, loss, or damage incurred during a stay.
  • ∙ Errors in listings or communication between users.
  • ∙ Any disputes between Guests and Hosts.
• 7.3. Our maximum liability to any user shall be limited to the amount of service fees received for the specific booking in question.

8. Platform Use

• 8.1. Users agree not to:
  • ∙ Create multiple or fake accounts.
  • ∙ Post misleading or inappropriate content.
  • ∙ Circumvent the platform to avoid fees.
  • ∙ Interfere with the platform’s functionality or security.
• 8.2. We reserve the right to suspend or terminate access for any user found in violation of these Terms.

9. Intellectual Property

• 9.1. All platform content, including the website, branding, and software, is the property of Back Room Bookings Pty Ltd.
• 9.2. Listings remain the intellectual property of the respective Hosts. By listing a property, you grant Back Room Bookings Pty Ltd a non-exclusive right to use, display, and promote the listing on the platform and associated channels.

10. Privacy

• 10.1. Your use of the platform is also governed by our Privacy Policy, which outlines how we collect, store, and use your personal information.

11. Compliance

• 11.1. Prohibited conduct of fraud, money laundering and shell entities.
• 11.2. Agreement to Know Your Customer (KYC) & Know Your Business (KYB) checks and cooperation with investigations.

12. Governance Law

• 12.1. These Terms are governed by the laws of South Africa.
• 12.2. Any disputes will be subject to the exclusive jurisdiction of the courts in Pretoria.

13. Modifications

We may update these Terms from time to time. Continued use of the platform following such updates constitutes your acceptance of the revised Terms.
